Weight Restrictions & Bonding Policy

Reductions of speed (reduced to 35 m.p.h.) and weights (reduced by 35%) during the spring thaw.
WHY RESTRICT WEIGHTS?
Weights and speeds are reduced to prevent the damage to flexible based roads during the exit of frost from the ground.
State law mandates the institution of weight restrictions on March 1st of every year.
Individual counties can post weight restriction before March 1st if weather conditions demand.
WHAT ROADS ARE RESTRICTED?
All flexible based roads. For a truck operators map contact the Kent County Road Commission.
CAN I BOND THE ROAD?
Bonding of the roads is possible only to those businesses and individual who meet the following conditions:
The bond will be $10,000 per mile but not less than $5,000 for less than a .5 mile. The permit fee for each contiguous segment of bonded road will be $250. Each vehicle will carry a copy of the permit or other proof of authorized
destination.
WHAT IF MY WELL GOES DRY?
Bonding may also be possible in emergencies such as loss of existing utilities and services.
WHO DETERMINES IF THE ROAD IS DAMAGED?
The permit fee is used to video tape the bonded section in order to document the condition of the road before and after weight restrictions. The district foreman will also make notations on the condition of the road before and after.
WHAT IF THE DAMAGED SECTION IS BONDED BY MORE THAN ONE PERMITTEE?
In the event damage occurs to the road permittees will be assessed damages in the amount up to the limit of the bond. Multiple permittees will be assessed damage in proportion to daily trips. Every effort will be made to limit damage by frequent inspections. the Road Commission reserves the right to revoke the bond to prevent further damage.
WILL THE WEIGHT LIMIT SIGNS ON MY BONDED SECTION COME DOWN?
No. To protect you and your bond we leave the signs up to prevent unauthorized vehicles from damaging the
road.
